My daughter is a witness in a crown court trial for GBH but really does not want to go, we have been twice and the case was put back twice! She accepted the last summons served on her but we have been told if she says "I dont wish to accept this summons" there is nothing the police can do? Is this right?

If court were invitation only, then I wouldn't have the name I do.

Accepting the summons is not a "choice" she can discuss this with the DA about not wanting to testify, but they can force or require her to appear

Thanks for that, and I am aware excon that it is not an invitation! But the defence barrister made what I thought was a gentle hint he said " well if the summons is not accepted then not a lot they can do, and thats all i'm saying on the matter" so I'm really not sure what he meant.

I don't know what he meant either. I'd get clarification if I was you. It IS important, no? I like straight talk from my lawyers. I'm not too good at picking up gentle hints.

In your case, it may be true that they'll do nothing if you don't respond. But, I seriously doubt that they're PREVENTED from doing anything.
