What is a residential eviction process in CA. What happens after the three days to pay or quit notice can we or when do we file an appeal and where do we file it?
If you have been served a pay or quit, you have to pay up or move out. If you do not vacate within the 3 days the landlord then goes to the local housing court and files for an eviction order. You will be served a summons and notice of a hearing. At the hearing, you should be given the opportunity to pay in full. You can also explain to the court why you haven't paid. If you don't have a valid reason or can't pay, the court will issue an eviction order. Generally this will give you a short time to move out usually less than 10 days. If you still haven't moved out by then, the landlord hires a sheriff to physically remove you and your belongings.

If you have a good reason WHY you're withholding rent, it won't matter to the judge in your eviction case. In the law, there are OTHER ways to get the landlord to do his duty. If you just withhold rent, you'll BE evicted, and he can be an a$$hole to his next tenants.
