It may depend on what was outlined in his probation. If he is in violation of it things may get a bit difficult for him.

I think ALL probation carries a condition that a person stay out of trouble and not get arrested again. I am not aware of any probation terms that state otherwise.

    I see a violation.

Since he is on probation more than likely drinking alcohol is not permitted and neither is driving while drunk. He will be violated and will have to attend a Probation Violation Hearing at which time the Judge could order his entire probation revoked and send him to jail for his original sentence. Or he could order more probation.

He will almost for sure, get violated and have to go back to a hearing before the judge.
** and he needs to report this DUI ASAP to the PO if he has not, since not reporting is often considered a wost offense than many things that happen.

If drinking had nothing to do with his other crime, they may after the hearing do nothing but it is hard to say, really up to the jduge
