Hi, my sister and I rent an apt, we decided to move at lease renewal time, we have a place we are moving to. (both in Florida)

We were to move out of place #1 on Friday Dec 1st, they showed the apt last Sunday and said the guy could move in on Monday the 4th...

There is a delay in place #2, and we may not be able to move into it for another week or so (until the problem is corrected) what do we do?

Can we stay where we are and paying the rent (via new amt) per day or week? Or do we have to rent a storage, rent a motel, and pay for the movers twice?

We are having a nervous breakdown over this unexpected ordeal and have no idea what we can do.

Also after seeing the "Squatters, Help!" post I feel the need to say we are not squatters and have no intention to be! We have a lease agreement already with the new place, it is a repair that has to be fixed before they can allow anyone to move in there by Florida law, and it was suppose to be done in time but the worker is "behind a bit" grrr

We just need to know the law on staying in our old place for a little extra time is all... we have paid the $3000 for the new place, (so we have proof that we have rented another place), we can pay per day/week to stay here, but we will find it very hard to pay $750 for the movers twice, the $100+ for a storage and the $358 week for the cheapest motel deal in our area.

You rent a U-Haul truck, put your furnishings in it and go live in a motel... you don't have the right to remain in a property after your lease or notice has expired.

Yes, if you remained, the person who is expecting to move into your place could have legal action against you for any of his loses.

You could talk to your landlord, let your landlord talk to this person and see if they can wait a week also. But if they can't, you need to be out so that person can move in.

What is the problem where you are moving, if you have a written commitment to move in, they may also be liable to you if they don't let you move in on time.

Well we do not have the funds to pay the cost of Movers and storage and a motel in Florida unlike many other states including yours, it is VERY expensive to live here.

We have paid $3300 to be exact for the new place, that is not counting the fees to have things moved like the lights, and having other things turned on there that are not the company's we've used here.

It will cost us $375 for the movers, if we need storage we will then have to pay storage which is about $100 and then also pay the movers again when the place is ready to move us in there. Motels - the cheap deal that is - for our area is $358 a WEEK, or $75.00 a day...

We do not want to delay the person who is moving in here either but he lives with his parents and they also are paying the move in costs, so he could be delayed and be OK at his parents.

Basically I was wanting to know the Law for Florida on this issue. The people we are renting the new place from expected the work to be done in time, so they can sue the repair company, this is a hurricane damage repair that was found when the last tenants moved out, that by Law has to be repaired for new tenants, by law nothing or no one can be in there until it's repaired and inspected. (it still may be done in time even)

We have always paid our rent on time and never been a problem, we followed the lease to the letter, this is not something we had/have control over. We are sisters, we are not slackers we'd pay for this place to be honest it would be cheaper to pay a full months rent here at the new increased amount then pay all this extra.

I guess we just stay and then face court action if that is the owners choice or the new person takes action against us, I think we legally can since this is directly related to state/county ordinances/laws and the result of an "Act of God" in legal terms, we have proof that it was out of our control. This is a mess! Anyway thanks for your replies...

Notify the new people, the day they come up to the apartment, with a signed lease showing they are the lawful tenants, is not going to be a good day.

If you can't work something out with the new tenant moving into your place that will let you stay longer then you should look into having your new landlord pay for the costs of the delayed availability of your new unit. If they said in writing that you could move in on December 1st but the unit isn't available you should make them responsible for the motel and storage fees.

Try this... cancel the movers (they are a RIP-OFF anyway). Put your stuff into one of those P.O.D.S. things and move into a motel--this will save you buckoo bucks on the movers, and then you could afford to stay in the hotel for a week. You should also check into having your new landlords pay for your stay at the hotel and your rental of the P.O.D.S. thing. Moving yourself is MUCH cheaper and then you don't have to deal with the fraudulent charges moving companies love to tack onto the bill before they deliver your stuff--assuming they don't steal it to begin with! (Sorry, I have absolutely NO faith in moving companies--too many horror stories!) If you are unable to actually physically move your stuff, ask a couple of high school/college students if they'd like to earn a few bucks by moving your stuff--if they're old enough, throw in some beer and pizza, and you'll be set! :up:
