    If the father has not seen the child for a year can the mother get full custody of her child? He does not give her money nor call about his daughter and he is in and out of jail. Would it be easy to get the custody?

    I really depends on where you live. My sister went through a similar situation and was awarded full custody because my neices father didn't even show up to the custody hearing. The father works under the table so he doesn't have to pay child support to. You should definitely file for child support because if he ever starts making money legally his wages will be garnished, even if he waits until you child is 18. He'll have to pay all that back child support, but that will only happen if you make sure that information gets into the system.

    Does she not have custody, if you say he does not pay support there has to be a order?

    But it will help to get custody, not stop him from getting visit rights.

    1. is there a custody order now ?
    2 is there a child support order now

    I assume the child lives with you, Therefore you already have custody. What more do you want?
