I live in California, USA.

I worked only one month ( January 2009 ) and then I got laid off and didn't work for rest of the 2009. My wife did work ( and continue working today ) whole 2009. I became her dependent ( H4 visa ) from February 2009 onwards. We have one kid as well.

My questions ---

1. Should I be getting whole tax withheld refunded?
2. How will I get more refund
2a. Married filling jointly
2b. Married filling separately.

Advise. Your time and suggestions are greatly appreciated.

You should look into the Earned Income Tax Credit for a couple that's married filing jointly. Depending on your families income you may be able to get a better refund. It would probably be most helpful for you to consult a tax professional.

You should file joint return to get maximum benefits.
