    Can I be on probation and serve jail time at the same time
    I am serving 3 years probation and have to use vacation time to go to jail. In one year I have to serve 3 weeks the next year I have to serve 4. Is this legal? Isn't it either one or the other? I also have no contact with co-defendant as well and the victim.

    Your jail time is most likely conditional time. Meaning it is a condition of your probation. Yes, this is legal. Most probation now comes tacked on with conditional time. I've seen people that have to sit every weekend for like 3 years worth of their probation. It usually doesn't get split up like that, however be happy that it is. That way you can actually take vacation time to cover the short term jail stay instead of losing your job because you have to sit 2 months.
