    L1 VISA and filling 2009 tax return
    I came to US on L1 Visa on July 2008 and filled the return as 1040NR-EZ for 2008. I went to back to my home country on end of April 2009. And again came back to US on same L1 on mid of Sep 2009 and I am in US now. My questions are,

    1. Do I need to consider dual status option for 2009 tax return(does it applicable for L1)? Or should I file as Resident allien for 2009?

    2. Now I realised that I should have filled as resident allien in 2008 also. I stayed 193 days in 2008. In fact I did through tax conusltant but I don't understand why she used 1040NR-EZ. Do I have any option to change this now (amend)?

    For 2009 file resident tax return.
    For 2008, you are dual status. On dual status, just like nonresident tax return, you do not get standard deduction.
