    I am an Indian. I came to US on a F-2 visa. One year after I converted my status to F-1 for studying masters. That was on 14th January 2009. When I consulted regardng the tax return for 2009, I was told that I cannot claim the deduction amount of $5700 eligible for a student under US India tax treaty. Is this true? Is there a way to claim this amount. My wife is also a student here. She has no problem with that, since she came on a F-1 visa.

    You will also get treaty deduction for 5 years. This 5-year period include the years you had F-2.
