    I signed a lease in nov 09 and just got a notice in the mail that says the property is going on action in 2 days. I gave my landlord a security deposit. Can I get that back on sue him for the rest of the months left on lease? How long do I have before I move out? I live in va

    First, there is a sticky note at the top of this forum that deals with this issue, may I suggest you check it out.

    What did the notice actually say? A foreclosure action can take 6 months or more. The owner can forestall the foreclosure right up to the auction time. So until the property changes hands you are obligated under the lease.

    If the foreclosure becomes final and the property changes hands you will have at least 90 days (by federal law) to vacate.

    You can try suing the landlord, but if he allowed the property to go through foreclosure its unlikely he has money for you to recover.

    You can not recoever anything except the deposit ( but doubtful he has it) winning in court does not mean you get paid.

    You can not sue him for the rest of the months on the lease ( unless you paid him in advance)

    When it sales you will need to pay who ever the owner is.
