I have a 3 yr old daughter with a woman that is clearly mentally unstable. I've just had another incident yesterday at 6:30 am where she comes to my porch screaming and pounding on my door like she was trying to break in. We haven't been living together for almost 2 yrs. After calling the police they briefly stated they had been having problems over the previous night but didn't say what but did say she was clearly unstable. They did ask me if she was on drugs when she came here. I told them I didn't know. Upon further contact with the police later we found out she was being evaluated in a hospital miles away. Now this is not the first incident like this. When we were together she was hospitalized at least twice in 3 yrs for mental illness, the first time being her attempted suicide when she was pregnant with my daughter. We were never married so certain laws in my state kind of are one-sided I feel. Aside from that, I have no record of to speak of. Do I have a good chance of getting custody of my girl as I am really worried about her. Any help on this subject is greatly appreciated.

No one can guarantee how a Judge will decide. You need to file for custody and present evidence to PROVE the mother is unfit.

The Judge will evaluate all parties and determine what is in the best interest of the child.
