If He Back In To You He Is At Fault. Notice to Your Insurance Company And File A Police Report.

Not enough details for us to tell you anything, were you in a car or walking,

If you were in a car what was your direction of travel, going forward or backward, did you back into each other,?

Was it in marked lanes or merely open parkinig lot.

But in general of course he is gong to claim it is not his fault, that is legal advice, our company has a manual for company vechiles, first number one rule if you are in an accident never admit you are at fault, make someone prove you are.

Did you get any witneses from the sidewalk or store that saw it happen?
Was the police called, was there a report done.

And lastly, turn it over to your insurance company and let them deal with him

Generally, the driver backing up is at fault. Especially if you were stopped. But this is not your problem. All you need to do is report it to your insurance company. Explain exactly what happened. The insurance company will decide whether to file suit against the other driver's insurance.
