I live in IL. The father of my child is not on the paternity or any papers. I was wondering if making him pay child support would help him in any way get rights since he then would be on the paternity papers? Also I made a police report on him when pregnant of him choking me,pushing me, and smashing my belly at 6 months along, he has a terrible drinking problem witch I have witness's of this, and I've been keeping a log of when he comes over and don't when he's supposed to and he's missed DRs appt . Is this enough to prove him unfit?

Not really. Its enough to prove bad behavior but not unfit at this time. It may be grounds for supervised visitation is about it at this point. And he should be on child support regardless of the position it puts him in.

He has all the same ability to claim rights no matter if you file for support or not, support and rights are too differnet issues.

He merely has to prove he is the father to file for rights, and that can be done by DNA test though the courts.

You will of course have to prove this to get child support, so it is one less thing he has to do, but he can do that with or with you filing for support.

He has no obligation to go to the doctor with you ( if that is what you are saying missing doctor appointments)

He attack on you, there was a police report, but what happened, was he arrested, was he convicted?

If you report it and the police say they did not find any evidence and drop the case, or if the DA droped the case, while it is evidence, unless he was convicted he will try to claim it did not happen.

Custody and child visitation courts are very down and dirty fighting, often both sides go in and lie on the other, and the judge knows this, so the burden of proof is on both sides to prove their case

Thank you for your reply. I let him see the baby I know he shouldn't on his own that's all. So supervised visits would be great. Thanks

Thanks for your reply. I meant doctors appt. that he say he would attend then not answer his phone nor show up. And I made a report I did not file charges so just me writing tem a statement is all. I let him see the baby when he wants to, but often he does not show up or call when he's supposed to come over. I just know the baby wouldn't be safe unless he was supervised so the thought of it terrifies me. Hes the type that would think its cute to get the baby drunk . Thanks again for the info
