I want to report my dad for child and spousal abuse but I do not want my mother to be charged with child abuse as well. She is not abusive.

If I report my father for child abuse, will my mother also be investigated?

If I report my father, and my mother is investigated, will there be separate trials?
If there are separate trials, if my father is found guilty and my mother not, will he go to jail and me, my mother, and brother be able to live together?

How can I make it so my mother does not get into legal trouble but my father does. She has not been abusive toward me, my brother, or my father. She does not deserve jail time or any other form of punishment as she too is a victim in all of this.

Do you believe she may be suspected of abuse? If this is reported I expect the authorities will investigate the entire family situation. But if there is no reason to suspect her of doing anythiing wrong I am puzzled why you believe she might be charged.

How old are you?

I'm 17. No there isn't any reason she would be suspected. She hasn't been abusive. But when my school first found out about the abuse when I was younger, she said that if I didn't take it back, she would be charged and I would be put into fostercare even though the only abuser is my father.

I do not know if this was just to scare me and protect my father or if this was true.

It's probably her way of protecting your father and attempting to keep your family together. She would rather be abused than have this come out into the open and deal with the problems that would come with this kind of thing. That's why she told you what she did.

By her not taking action it can be a crime. Also if she chooses to stay with the abuser then its bye bye children and the state takes them away to remove them from the situation. That's how it works.
