    I have $800 in my 401K will that result in me paying more each month in chapter 13
    Should I take it out before filing the chapter 13 and pay off bills or risk it? I know a lady who had to pay $50 more a month due to having $1300 in her 401K.

    You have to swear to your present and past financial dealings so taking the money out (unless you can prove why you did so) will not help you.

    What does your Attorney say?

    I haven't asked her yet. My first meeting with her, she just asked me how much was in there and said "oh that's ok.", that was a couple of months ago and now I have about $300 in there more than when I originally talked to her. I meet with her again Monday to officially file. I would hate for her to say it's OK and give me an amount of how much I will pay for the next three years monthly and then get in the trustee's office and him tell me I have to pay a lot more a month. I can barely afford to pay my bills as it is.
