    Enforcement Hearing
    My fiancé was recently told by her Child Support worker that her ex is going to issued a letter for an enforcement hearing in the state of NJ because of child support. They were supposed to take it out of his pay check when we went to court and had all this settled. I was wondering what usually happens at these enforcement hearings? I've been told many different things from they inform him he won't be getting a tax return to issuing a bench warrant for failure to pay child support. When we went to court he was 2 years behind, the judge allowed him to make payments to the arrears, an extra $100 a month and since then he has fallen even further behind in the child support payments of arrears because he hasn't paid since that court date in September

    I'm not in NJ, I'm in NY but I've seen "decisions" all across the board.

    Depends on past behavior and performance... and the mood the Judge is in that morning.

    He filed a custody violation on us last year and we had court in September. Our lawyer had brought up about the 2 years he did not pay any child support to her. The judge set the arrears amount well above $7,000. He was then ordered to pay $400 a month for child support along with $100 a month extra to pay towards the arrears. He also failed a drug test that he was court ordered to take. Since that date(september 25th) he hasn't paid any child support to her but keeps calling me telling me he's sending checks and hasn't sent any.

    Don't expect the hammer to fall. Its usually in the best interest not to send someone to jail. On the other hand if there is neglegent behavior then it can go a different way. Also if he isn't working he will have to explain why.
