I live in L.A county, my car was hit by a city trash truck and subsequently destroyed about a year ago. I have tried to call and receive payment, but I am now being given the run around. I am wondering if anyone else in the l.a area has had this happen to them and how long it took them to have it be dealt with and how you dealt with it.

You should have turned this over to your insurance carrier the moment it happened.

Unfortunately in my case that was not an option. Thank you for the reply though. I'm looking for people that have been in the same situation with the city.

That's going to be tough here. You see, we are a worldwide website. Very few members live in LA, and those few that do have probably never been hit by a city trash truck.

At this point your only option is to hire an attorney to straighten this out as LA is obviously stone walling you successfully on this.

I'm actually taking a different approach that I think will be more effective and free.I need to see if I can find more people in my situation so that I can do it more effectively.

I've been on this site a long time; I've been around the practice of law a long time; you are the only person I've heard of, here or anywhere else, who has been hit by a City trash truck.

Your chances of finding someone who was hit and did nothing for a year are slim to none.

In my area a Notice of Claim against a municipality must be filed within a very specific time frame - 90 days. I realize this doesn't impact you and you are only looking for people in your same sitution.

I have no idea what "different approach" you are taking but it doesn't appear to be working for you so far.

And please don't use text speak on the legal boards.

At this point I think OP's just going to be doing a lot of head banging as his window to file the Notice of Claim against a municipality came and went.

That's probably WHY they are stonewalling and/or totally ignoring your claim regardless if they are at fault or not.

Sometimes when a person tries to handle lawyer stuff on their own they tend to miss the important stuff an attorney or insurance company would have caught.

This is the issue, it has been a "year" if they were ever going to just do something it would have been done in the first 30 to 60 days.

1. was there a police report
2. who was declared in the report as being at fault.
3. where there other witness of the accident.
4. what is the value of the car ?

5. why could you not turn it over ot your insurance??

I apologize greatly for using "text speak", I did not mean to insult your superior intelligence. As far as doing nothing, you have no first hand knowledge of my situation and do not know what avenues I have explored to be able to make the judgment that I have done nothing for a year.
I am fully aware that by posting this message on an informal "legal" board I am subjecting myself to the opinions of everyone who reads it. While I am at the mercy of the reader, I now realize it was naïve to think that I would only get responses to the question at hand and that was to find anyone who is or was in my situation. This is the first time I have ever posted a question, due to the lack of helpful and/or constructive responses that apply to the question, I will not be doing so again in the near future.

Look, I'm not trying to give an attitude. I also understand that there are people willing to help, which I appreciate. I'm just looking for help from people in my particular situation. I do get that its like looking for a needle in a haystack but its worth a try. As far as everything else goes its all common sense stuff that I have tried. I understand that this is an worldwide website, but I just typed my question and found this site off Google, so I am hoping for someone else to do the same.
Also, I am more than willing to divulge more information to someone who has experienced this and gone through the process of filing any kind of claim with the city.

There's a lot of really intelligent, experienced people on this site. You'll probably get more help if you give them the details than wait around for someone in the same situation as you. Because while its possible, its slim to none.

Let me also say that Judy is an investigator and could give you the most help if you provide the necessary information.

People are more willing to help you if you don't give them attitude. And yes, you were trying to give attitude with your statement:

I have a TON of experience in the area of liability investigations - a ton.

I've investigated claims against individuals, corporations, municipalities.

I know how the "business" works.

You are not going to find someone in exactly the same situation you are in and your sarcasm is totally unwarranted. If by some very strange act of fate you find someone in your City who has been hit by a trash truck I am very sure that the circumstances of the accident will NOT be the same. I've investigated thousands of accidents and they are like snowflakes - no two are identical (although I do realize that scientists now claim two can be identical - but that's beside the point).

Doi I have superior intelligence? Maybe. Experience? More than you have, obviously.

It is not a very good idea to insult the very people who are attempting to advise you - I trust this is your attitude in life and the very reason no one will work with you to get this settled.
