Can I use the intending immigrants income tax returns to complete the poverty guidelines (I-864p) even if the immigrant was working illegally? I am petitioning for My father who has been working and paying taxes while out of status (I-94 expired in 1993). Thank you!

As a sponsor, your income must meet the poverty guidelines.. if not then you should find a joint sponsor.
