As ballenger pointed out, this should be addressed in your custody order.
If the NCP is moving out of state, their visitation schedule is going to have to be revised. Obviously, they won't be as readily available to take the children if they're living much farther away.
Well the state is Arizona, and the court order states that she is to check into rehab(which she refuses t do)and then she has to submitt proof of completion of both the rehab and aftercare program to the court and petion to modify the court order for more parenting time,but she left the state and like I said she hasn't seen him since August 2008.
As for her rights,she has supervised parenting time only,court ordered twice a month,but hasn't shown up to see him since 2008, she got in trouble with child protective services for neglect and abuse and tested positive for meth use,she refused the requirements from them so I took her to court for not only custody,but for her to go to rehab,she is adhd bipolar and a drug addict,
She can do whatever she wants. She ovbiously has no great interest in seeing her child if she hasn't in two years. The order for rehab is only for her to get her parenting time back and if she doesn't want that she doesn't have to do the rehab she just sacrifices time with her child which she apparently has been doing for quite some time. I'm not entirely sure what you think the problem is other than you want her involved in the child's life and can't force it. If that is the problem move on and be happy that you have a stable home for the child and try to do what you can to help the child deal with the fact that his mother is gone with out any contact.
