I have been on welfare for the past 18 months receiving cash aid and food stamps. My ex-husbands arrears total $59,000 and the amount owed to the state is about $57,000. Question for you... if he starts paying child support now, and I am still receiving cash aid I only get $50.00 per payment correct? What if I stop receiving cash aid? What percentage will come to me versus paying back the state for arrears?

The state gets their money first. You would still be taking food stamps.

They set his payment towards arrears at $100.00. If I went off welfare entirely, would I receive any child support? Or does all of the child support that he will be paying go to pay back the state?

All but a small portion. I doubt the $100 you would receive is more then the benefit you are receiving now.

The actual child support and revised spousal support total about $800. They ordered the $100.00 a month towards the arrears that is owed to the state.

The state will take their money first. And as far as he is behind there won't be much left over.

o.k. thanks. When we were outside of the courtroom trailing with the child support officer she said something to the effect that if I stopped receiving cash aid I would get child support. So I just wanted to ask someone to find out if that was true. Now I see it's not. Thank you very much!

By signing up to receive the state benefits you sign away your support until he has paid back what the state paid you. That is correct. Now, in my state, if you didn't get the cash assistance (wich you already do) then you would receive the food stamps but your child support income would count as income and your food stamp amount would decrease by that much (or however much it equals out to in the determination calculation). Being that the state is owed so much money I wouldn't count on seeing any support payments directly from him. Good luck to you though.
