I rent out a room in a house where I live with my landlord/roomate. Problem is
That my landlord/roomate smokes pot in the house. I realize that when I moved in that he allowed smoking in the house. However, I was unaware that he is a daily pot smoker. I've talked to him about it and he said that he would "cut down". I explained that the smell bothered me and he said well "John" smokes cigarettes in the house and that there is no difference to the smells and that I knew smoking was allowed in the house when I moved in so I really shouldn't complain about the smell.
He's pretty adamant that he will continue smoking pot but that he will "cutdown" (and has yet to do so in the two weeks since we talked).
As an ex-smoker I don't mind the smell of cigarettes but I can't stand the smell of marijuana. When we spoke (we spoke on the 30th of January and told me he'd "cut down" on his pot smoking I told him that wasn't good enough and tried to give him a 30 day notice. I gave him notice and he said well no you can't do that February doesn't have 30 days so I can't except this until the end of February and so I can't move out until the end of March. I cannot stay here for another month and half and have to put up with the pot smells.
Question is what were to happen if I moved out on the 1st of next month without notice. Can he sue me? He has my security deposit. I realize if I leave that I basically just forfeit that deposit, but since he is breaking the law by smokin pot in the house is there a way I can obtain the deposit back without giving 30 days notice?
