Can I be arrested for adultery in the state of il

I am seeing a man that is married and his wife says she is going to get me thrown in jail can she do this

No, she can't. I'm going to keep my big mouth shut for the rest of the story.

While adultery is grounds for divorce in IL, its not a criminal act. Some states still have laws against adultery. But I doubt, even if it was a criminal act, I doubt if any DA would prosecute it.

It's funny that it's still technically illegal in some places! Hey, if she keeps harassing you about getting you arrested, then perhaps you could bring up the fact that her husband is just as guilty as you are of adultery and he would be in the same legal jeopardy as you if she insists on trying to bring charges.

As Scott pointed out, some states have very old laws which are still "technically" legal but most attorneys won't prosecute for something like this.

And I do not recommend harassing your lover's wife by any means. Harassment is something that you can and will be prosecuted for. Saying "I'll tell on you if you tell on me" is childish and terrible legal advice.

Sorry you misunderstood me, I did not tell her to harrass anyone! This is a silly matter and the post was made in a light hearted manner! I simply meant that if this woman contacts her again and threatens her with jail, that she could say "Well, if I'm going to jail for adultery, then so is your husband!!" As in the age-old saying, "what's good for the goose is good for the gander" or "it takes two to tango". Of course, the sole intent would be to stop the woman from threatening her, not to ACTUALLY tell on him! How exactly does the wife think she would get this woman convicted without having her husband get in hot water too? I think the wife is no doubt angry and is saying this out of anger and not thinking it through... I mean, really, how could she bring about charges against the "other woman" only and not implicate the husband in the process? Bringing that little factor up would probably end the harassment! I thought the light tone was obvious, but I apologize for the confusion!

Once again, as you have been told numerous times before, this is a law board and our answers here must conform to the law. If you want to make jokes and encourage childish behavior, the relationship board has plenty of threads like this.

You should know better than this at this point. This is a LAW board and answers need to conform to existing statutes. Therefore, your initial post was not appropriate for this forum. If you haven't learned the site rules by this point after so many run-ins with the MODs I wonder if you will ever get it. Quit while you are behind.

No, you can't be arrested for adultery. If that was the case then way too many people would be in jail too many times. Those are outdated laws and not enforceable any longer. I'm sure wifey still thinks they are enforceable.

Many of the "bedroom" laws are no longer enforced while many are stll on the books.

But no she can not, she can of course file for divorce, get alimony and property division.

I thought you understood that the legal boards are different from the other boards. There are NO "silly" questions. Quite candidly some of the things you have posted struck me as somewhat left of center but I still answered them to the best of my ability.

The person who posted this had a serious concern and telling her it is a "silly" concern helps no one. Yes, adultery IS a crime in some States. Whether it's enforced depends on the local authorities.

Please - if you can't answer in an adult manner, please don't answer at all.
