    F-1, Resident for Taxes Purposes
    Hello, and thanks for your time.

    I have been living in the US for about 7 years.
    I am still on a student Visa, but since 2008 I have been filing the 1040ez, since after doing the Substantial Presence Test, I fell under the category of "Resident for Tax purposes."

    For the past two years I have paid FICA taxes.

    My question is regarding "Making Work Pay Credit", and Earned Income Credit:
    I read somewhere "Non-residents are not eligible" for these credits.
    Are they referring to non-residents in terms of immigration, or non-resident for tax purposes?

    As I have been filing as resident, and paying taxes as I resident, I think it would be fair to receive the same benefits that residents do.

    Any ideas?

    PS:

    Actually, should I file 1040A instead?

    I have a large private loan, however I did not make any payments during 2009, so no credit for that.
    But I did make a large tuition, and room and board payments, could I get any deductions by using 1040A?

    Since you are filing resident return, you will get Making Work Pay credit.

    You must file schedule M (Form 1040 or 1040A) to claim the credit. Include the credit on line 63 of Form 1040 or line 40 of Form 1040A. If you are filing Form 1040-EZ, include the credit on line 8 and do not file schedule M. Those with AGI of more than $95,000 ($190,000 if married filing jointly), nonresidents and dependents do not get this credit.
