    When did you enter the U.S. on F1 visa? Which date your H-1B start?

    August 2004 (was a student from 2004-2009 aug.) and started HIB August 2009

    Your F-1 exemption expired on 31 December 2008.

    Any argument for a closer connection to your home country was undercut when you submitted the H-1B visa paperwork.

    You are a resident alien for ALL of 2009; file as a resident alien, filing Form 1040, 1040A or 1040EZ.

    My situation is almost the same as the person above. I came to USA since Aug. 2004 with F-1 visa and graduated in May 2008. I work in my OPT from Nov. 2008 to Sep 2009 and start my H1-B on 10/01/2009. My question is whether my F-1 exemption expired on 12/31/2008 or Aug. 2009???
    I thought we are exempt for 5 calendar year.

    On F-1 you are exempt for 5 years 2004, 2005, 2006, 2007 and 2008. For 2009, you will file resident tax return.
