    I am on H1B from first oct 2009, can I fill 1040EZ for 2009 tax return?
    From sep 22nd 2008 I am in US on J1 visa and I filled 1040 -EZ for tax return 2008. From oct 2009 I am on H1B visa, can I fill 1040EZ for 2009 taxes?

    You filed incorrectly for 2008; you should have filed Forms 1040NR-EZ and 8843.

    You will file Forms 1040NR-EZ and 8843 for 2009 as well.

    If you are married, you can file joint return as resident under First Year Choice. Must wait to file your return till you complete SPT in 2010.
