If you are on the birth certificate, then she needs your permission. In order to legally change the child's surname, she'll need to file in court.

I'm sure you've heard this already but you need to file in court as soon as possible in order to secure your rights as the legal father. Without a court order, she can leave the state and not tell you about it.
