    Is my lease breached if it is written on the lease that there is a maximum occupancy of 5 people to be living in the house and there are currently six living and paying rent? The lease describes that "this dwelling will be occupied by a maximum of 5 ( the number being filled in by pen) tenants...". The total monthly payment is still set up for the amount where 6 people would be living in the home. Any insight would be greatly appreciated. If any additional information is needed please ask. Also any opinion on what I should do would be fantastic. Thank you so much in advance!

    Yes, if there are six people, and the landlord does not give written permission for thiere to be six, and the lease says 5, the landlord can give you notice to move out, or reduce the number of people in the house, if you don't, the landlord may evict everyone.

    The landlord knows that there are six people living here. That was their intention. I'm asking if I have an advantage because of their typo. Please tell me?
