Our daughter at Univ of Idaho is on a year lease for an apartment. After this year, they want either a 6 month or 12 month lease. This will mean that when she graduates in December, 2011, she will still owe 2 more months on the lease. Aren't their renter laws that allow month-month after at least a year lease?

Given that she will graduate in Dec and not June, it may not be as hard for the landlords to find a new tenant immediately (rather than if she graduates in June and they can't find someone until Sept).

But the landlord controls things here. If the landlord requires a 6 or 12 month lease, then the tenant has to agree or move.

She asked, they are insisting on a lease, she wants to go month to month after 1 year. What is allowed?

Thanks, this helps a lot.

If the LL says it must be a lease then it has to be that way. There are no laws requiring anyone to rent on a month to month basis.

OK, that answers it! Another daughter just graduated from law school and she said that in Washington (or maybe Calif.) there was a law requiring a month-to-month option after a year lease. She could be wrong!

It does go to month to month, unless the lease auto renews, but the landlord has the right to require a new lease.

What a lease can do, if nothing is done, there is no requirement that a lease has to end or not be renewed.

Most states do allow for a month to month lease IF neither party requires a new lease and both parties agree to continue. But the landlord can require the tenant sign a new lease or vacate. Most states do not require that the rental go month to month after the lease expires. Just in the absence of a new lease.
