    Can I claim my parents as dependent while filing taxes
    I am on H1B visa in US from past couple years. I have sent money to my parents but my parents live in India and haven't visited me in US yet.

    Is there any way I can claim my parents on my taxes by getting ITIN number ?

    Experts please advice.

    Hi MukatA, Thanks for the note.

    Discussing further , I am having a confusion... that even if my parents are not citizen or resident of the U.S can they still get the ITIN number ? ( I am neither a permanent resident or US Citizen but I still file taxes).

    Is getting the ITIN number would be the only eligibility to claim them as my dependents or there is much more involved into it.

    Any insight such case ?

    Your parents must meet residency requirement that they live for 183 days in a year in the U.S. or complete substantial presence test. Your U.S. Tax Return: Substantial Presence Test

    Hi MukatA,

    I Understand you point and thanks for clarification.

    The money that I have sent my partents in 2009 , can I claim that amount towards my deductions while filing taxes ? If so is there any limit.. for example I can only claim X% of my total income toward such deductions.

    If your parents are NOT located in the U.S. then you cannot, in any way, shape or form, deduct payments to them.
