Can I work a job any place with a embezzlement misdemeanor?
Can I still get a job if I was just charged for embezzlement misdemeanor? I worked for a company and I embezzled some money, I got caught. The store didn't press charges, The police wasn't called and I was able to walk right out of the front door after my termination. All they wanted was to get paid back the money I took. I went to court, plead quilty for the crime the judge gave me a charge of embezzlement misdemeanor. I was finger printed, and my picture was taking. My sentence was 3 weekends in jail-where I have to report 3 friday's at 6pm and I'll get released on Saturday or Sunday morning, a lot I received 24 months probation and 8 days work release. Now my question to you is while I'm doing all that, I still need to work a regular job to pay back the money I owe plus fines and fees. With embezzlement misdemeanor on my record will I be able to apply for jobs like retail? Hospitals? Gas stations? Or etc. etc. Oh yeah every application I've saw so far only ask if you have been convicted of a felony? I put no. But when the company do a background check will the embezzlement misdemeanor charge show up? Will I still get the jobs? I'm very concerned...

Ok, police were called at some point, since there were charges pressed, and you went to trial ( court) so it does not matter if they carried you out fighting in handcuffs or you walked out the front door, at some point, charges were pressed and you were convicted.

The conviction will show up if they run a criminal background check, but many do not look as seriously at misdemeanors.

I would say as long as you are not working a cash register, have no contact with any company or customer money it may not hurt.

Of course if they have 10 applications with no criminal record what so ever and yours, guess who will normally get picked if you don't do a good selling job

And lets put it this way, you need someone to write checks out of your checking account when you are going to be away or in hospital. You talk to 4 people, one of them was convicted of stealing someone's money from their checking account before, would you hire them first or not consider them at all.

Embezzlement is still theft. Being a misdemeanor theft it will show up. It possibly will interfer with you getting hired to run a cash register in a retail setting. You can try, but don't bank on getting hired.

Not only will the charges show up, but increasingly, you have to be concerned about your credit score as well. (I mention that because theft usually indicates a NEED for money) And your online footprints stay around forever so if you post a pic of yourself in a compromising position it could come back to haunt you too. Companies are beginning to use these as factors as well when considering applicants.

If you keep your nose clean though, once enough time has passed employers may be more willing to overlook your past.

The charges will not necessarily show up - FrChuck is correct. It depends on the extent of the background check.

Employers are more and more frequently requesting checks for felonies only.

Does the info have to be disclosed if asked for? Yes.

Unfortunately for you, this will show up on your record if any potential employers do a background check. Also, if you were originally charged with a different offense, and your charge was reduced to a misdemeanor embezzlement; in all actuality it will show up as 2 separate charges. When I was 19, I went shopping with a friend using her sister's credit card (which I didn't know), and her sister ended up reporting the CC as stolen, so my friend was charged with theft, and she reported me as using the CC with her. Even though I never signed any CC reciepts, or even knew the CC was stolen, I was charged with a felony theft. The charge was actually reduced twice; first to a misdemeanor theft, then to a misdemeanor misuse of CC (which I was convicted of). A few months after this all happened, I applied for a job; which they informed me they do a background check. I told the manager about the misuse of a CC conviction, and he said as long as that was all that was on my record - I had the job. I was so happy, because this was the only time I had ever gotten into any trouble with the law, and I knew this was the only thing on my record. Or so I thought. The manager called me at home later that day to inform me that on my police record it showed that I had 3 different theft related charges over a period of about 5 months. I tried to explain that the charges are all from the same offense, and it wasn't 3 separate incidents. He didn't care, and I didn't get the job. I went to the ploice station myself and got a copy of my police report... and there they were - the original charge, the first reduced charge (approx. 2 months after the original charge), and the final charge of missuse of a CC (approx. 3 months later).

A police report shows any and all charges you have ever been charged with. It does not show which charges have been reduced or dropped; and does not state which charges you were convicted of.
