l1 visa - first time filing tax returns 2010
    Hi,
I came from India to US in 2009 April on L1 visa and have been working here since then. My spouse and kid joined in Nov 2009. Spouse is not working but she has got SSN but not for kid. My wages as per W2 for the period I was here this year is just under 40K. I would like to know
    1. What all deductions can I claim this year so that I can get maximum refund, in the light of new tax reliefs declared for this year?
    2. Can I claim deduction for moving expenses of me and family even if it was reimbursed by employer?
    3. Along with federal and state taxes withheld, can't I include social security, medicare and SDI taxes withheld from my pay, while filing the return?
    4. Do I need to apply for ITIN for my 1 year old kid before filing returns this year to be able to claim him as dependent?
    5. Do I get any discount for my expenses on purchase of car(old), gas for commuting to work purposes etc?
    6. Do I need to include my earnings and tax deducted in India for the period of the year I was there? Is it going to increase or decrease my refunds?

    Please help. Thanks in advance.

    1. File joint return as residents and claim your kid as dependent. Attach W-7 (ITIN application) for your kid with your tax return.
    2. No
    3. Did not follow your question
    4. Yes, file with your tax return.
    5. No
    6. You must both report your worldwide income for 2009 on the joint tax return. Also file Form 1116 Foreign Tax Credit or/and Form 2555 Foreign Earned Income Exclusion. Your U.S. Tax Return: U.S. Citizen or Resident with Foreign Income
