It depends on where you live. Doesn't matter when he is turning 16, if you are having sex with him now, it's possible you could be labeled a sex offender for the rest of your life.

Age of consent is 16 in Canada from what I've read. You should be okay

Having sex with an underage person is not your only worry. It will not do a bit of good for me to tell you this but getting pregnant is one of the downfalls of having sex at such a young age. Please use your head and try to hold off till he is at least old enough to get a job.

Another thing to consider is there are many many other things you can be charged with. They may not carry the same rap sheet quota as stautory rape but they are still on the books and you can go to prison for them.
