I was in an accident in march of 2009. It was not my fault but I was given the citation for "failure to stop at a stop sign" only because I had the stop sing not the other party involved. I fought it in court and it got dismissed. I thought that was the end of that. My inurance company was handling it and I was just waiting on a result. Then out of no where I get a summoms from the other guy's insurance company. They paid him over $11,000, sold his car in auction for less than $2,000 and now are sueing me for the remainder $10,000. I have to respond to this summoms within 20 days. I have no clue how to even start. Can anyone help me please. I have called lawyers but they all need a large retainer to even discuss this with me. I live off social security and can't afford a lawyer. I have to do this myself. Can anyone give me an idea on how to respond to this summoms? Please!! I don't have much time.

That's what you have insurance for. Your insurance company lawyer's fight for you. I had one filed against me many years ago for "lack of consortium" of the other party. Insurance company handles the bogus claim. "lack of consortium" means the right of affection of man and wife. The wife was the other party and the man was her husband.

You turn the Summons over to the insurance company which represented you at that time - that's what insurance is for.

I'd be grateful that the only claim is for damage to his vehicle and not personal injury.
