Tax Return L1 - Forms to fill
    Hello,

I am a french citizen living and working in the US (New York, NY) under a L1 VISA.
    I am married with 2 children (5yrs & 6yrs at the date /12/31/09).
We moved to NY on June 22 2009. I received my first US income at the end of July.
    I had a few questions:
    1) Which forms do I have to fill for 2009 ? My wife is not working in the US (L2 Visa)
    2) Do I have to declare my Jan-Jun 2009 french incomes to IRS ?
    3) Will I pay taxes on these incomes ?

    Thanks,

    David

    David:

I believe that I am dealing with you via email, but you essentially have a choice:

    1) You can file as a non-resident alien return (I am assuming from the email that you returned to France and did NOT meet the Substantial Presence Test).

    OR

    2) You can file jointly with your wife.

I believe we determined that filing as a non-resident alien is the best course of action for you.
