I am unemployed, have no assets and receiving Social Security. I have made deals and payment arrangements with all my creditors except Capital One. They will not do any long term, reduced fee type of plan. They are going to sue me. What can they do to me? Can they go into my checking account?

If you are on social security and that is your only income you are what is called "judgement proof" meaning although you owe the debt they can not garnish your ss check or if it is direct deposit they can't levy it. They may sue and get a judgement but they just can't act on it IF social security is your only income

My mother is going through this same event. She plans to file a bankruptcy. Capital one has been suing a lot of people. Just letting you know you're not alone.
