My husband and I have property in the desert, we go there to have fun, we have our toys out there, my husbands brother had left Oregon for who knows what reason had decided to make himself at home on our property without our permission every time my husband told him to get off our property he would threaten to kill him and in the meantime he started bringing junk cars and what ever he could find onto our property my husband and I had recently gone to court and got a restraing order against him but the judge would not put in the final restraing order to vacate the property, but in the temporary restraing order he did,we went back to the judge an had said he had overlooked this matter and he said we have to get another restraing order all over again to add this in there? We are very frustrated, brother has bench warrant in that county,no drivers license, running from child support and who knows what,lost a lot of work going to court and trying to cope with.

I don't understand if you have a question. If the Judge - who is familiar with the laws in your area as well as this particular matter - said you need to get a second restraining order, then that's what you need to do.

What did you do when you first found out he was there?

We had told him to leave to get off the property, he threatened my husbands life several times that why the restraining order,we called the police out there they have a copy of restraining order they had him in there costudy when he threatened our lives but they let him go knowing that he has a bench warrantwe can't be out on our property all the time we live in t he city so it is easy for him to take advantage when we go out there he is not around but all of his crap is it took us 2 months to serve him with papers and he didn't show up in court I am sure because he has a bench warrant, the police out there are pretty laid back

Normally I would agree on getting an eviction, but not in this case. If you immediately contacted the police upon discovering that he moved in, then he is not a legal resident and eviction is not the proper course of action.

I don't understand why, if there is a bench warrant for his arrest, the police let him go. You need to push the police on taking action.

I'd be interested in the time frame. If I know someone is living on my property, report it to the Police but don't follow up, don't file for eviction, do nothing I think the person is considered a tenant.

Curious to see how this plays out.

I still think I'd protect myself by filing for eviction and then see if the Police can pick him up on the warrant.

He has a warrant, call the local police in that area and turn him in, but also call the police department with the warrant and give them the same info.

Your husband first big mistake, when he told him to get off the first time, he should have called the police for him breaking into the home there and threatening to kill him.

But NO , you all have just let him live there, this actually in my opinion makes him a unpaid tenant on a month to month basis, since after the first time, you knew he was there and just let him stay by doing nothing to evict.
