Trying to serve someone over a county ordinance violation. Person refuses to come to the door. I left the citaion attached to his door. Make a notation on the citation that the individual refused to answer. Is this legal service?

I could be wrong on this, but I didn't think people who are not law enforcement were able to issue citations.

What state are you in? What ordinance did the person violate?

A person can not, to my knowledge, press crimiinal charges against someone.

Are you sueing them for money due to a lost because of this violation ?

But the city code enforcement person, or a law enforcement person will have to serve this

"Code official" is a new term to me, but okay. What exactly are you trying to serve this individual with? Who filed the complaint that said individual was violating the ordinance?

Hello d:

You are serving papers for some entity that HAS legal representation. THAT lawyer is the person you should ask. He's probably the county or maybe the city attorney.

If you're serving papers for the COURT, then I'd guess the you need some confirmation from the chief judge... In any case, somebody in your chain of command KNOWS the law, and I'd start moving up it, until I found my answer.

If you're an self employed process server, you need more training, and I wouldn't know where to get it.

Ask your employer what the standards and requirements are in your area, particularly for this type of service.

Otherwise - this is amazing! A process server on AMHD asking about the rules of service - ?
