Depends on whose fault it was. If you were not at fault at all, then they should pay.

It will all depend upon the terms of your insurance, state laws very greatly. In general unless you have bought a additional rider to cover you the owner for what is called "medpay" then a standard policy does not cover the driver/owner for medical payments unless you added it.
