My sons fater has not seen him in a year and now he is in prision for 2 years and my son doesnot want any contact with him. My son is 14 . Can I file abandoment? And we might move out of state and he has half and half rights?

You do not file for abandonment. You can try for a TPR. But, under current circumstances you should not move without court permission.
