    Tax for wife who is not currently in USA
    Hi,

    My wife is currently in USA since sep 1st 2009, I will be filing taxes based on that but my question is , she is likely to visit INDIA in 2010 & it may be possible that she may not return to US in 2010, in that case when I file my tax in 2011 will I still be able to get the benefit of filing jointly ?

    If you are on a work visa (H or L), you can file jointly with your wife regardless of her location.

    If you are on a student (F) visa, you can claim your wife as a dependent, again regardless of he rlocation.
