    Paternity in the Prov. Of Ontario
    I am a married father of three and stupidly had a short-term relationship with a divorcing woman. She is currently battling her husband in court over spousal and child support.

    When I tried to refocus our relationship into a friendship she discontinued birth control and aggressively tried to get pregnant with me. We have now stopped our relationship. She has now told me she is 2 months pregnant and wants my various financial records, etc as she will be pursuing child support from me in court when the baby is born in the summer.

    What are my legal rights and responsibilities?

    You don't have to give her anything until a court says so. How do you even know its yours ? Also turning a relationship into a friendship doesn't require sex last I remember. So until the child is born and something is started against you your just going to have to sit tight. When / if something does come of it then you can figure out what your wishs are at that time like custody and visitation etc.

    DNA testing AFTER the birth will prove whether you are the father. If you are, then your responsibilies include supporting the child.

    Until she can prove you are the father you have no legal responsibilities at all.

    I have looked at Ontario Law (I am not in Ontario) and it appears that her husband is presumed to be the father and it takes a Court action to change that.

    I think you should consult with an Attorney.

    On a personal note, what do you mean by "she aggressively tried to get pregnant"?

    Thank you for your help.

    To JudyKayTee: aggressively means going off birth control and initiating intimacy even though our relationship was turning friends-based. And yes, I am an adult and should not have had intimacy with her.
