    Is custodial parent in charge of paying all medical bills?
    In my current situation, in our separation agreement, I am in charge of paying half of my daughters medical out of pocket expenses. This is being done but wondering if in the right way. One month I pay her prescription medical and the next she pays. I am wondering if there is something in documented law that says if the custodial parent should pay and be responsible and give a receipt to the noncustodial to get half the money?

    As long as the two of you work it out where both agree, if not, normally one pays the bills and then the other has to repay them.

    The way it is done, is spelled out in your child support and custody agreement as to how it is done, if it is not spelled out, then you both agree or you end up back into court.

    As Chuck said, if the agreement only specifies that you pay half, how you do it is between the two of you.

    If you would prefer that the custodial parent pays the expenses and submits monthly receipts and you then pay half, see if the CP is willing to do it that way.

    You have the right to ask for documentation when there is a bill to pay. In general the one that takes the child to the doctor is responsible for the bill of that doctor. And according to your agreement your responsible for 1/2 of the co-pay. But if the meds are the same on a week to week basis then splitting it and keeping your daughter healthy the way your doing it is just as well. The only thing I would question is why weekly meds?? In today's day and times it makes no sense. If the meds are needed then in many cases you can mail order the meds and the price is much cheaper and many plans offer this up to 90 day supplies.
