    Taa stop being guarantor
    I am the guarantor for my stepson. The apartment complex used the TAA Lease Contract Guaranty form.

    I understand that I am responsible for the current lease term. No new lease has been signed yet that I am aware of. I would like to no longer be his guarantor.

    I am going to communicate my lack of desire to continue to my stepson but according to the TAA form, he and the apartment can still renew the lease with no further input or approval by me, seemingly in perpetuity.

    What is the proper way to notify the apartment management that I am revoking my guarantor status at the end of the lease term? I cannot believe that there is no way for me to give notice that I am revoking my guarantorship at the end of the current lease term.

    Hello david:

    At renewal time, I'm sure that a letter to the landlord revoking your guarantee WOULD end it. Send your letter certified, return receipt requested. Send a copy to your son.

    Is this the form you signed?

    If so, the language you are referring to would be this:

    Quote:

    You agree that your obligations as guarantor will continue and
    Will not be affected by amendments, modifications, roommate changes
    Or deletions, unit changes, or renewals in the Lease Contract which may
    Be agreed to from time to time between resident(s) and us.
    I agree with Excon. I would interpret this language to mean that, if you communicated nothing to the landlord until after the lease was renewed, you might be obligated. However if you renounce your obligation under the guarantee before the lease is renewed, you are not obligated under any renewal.
