My wife was pregnant when we married. She had the child within 90 days of the Marriage. We reside in Texas. The wife is abusive toward the children and I want to get custody of "my son". I heard that I am the legal father since I married so close to the birth and raised him for seven years. I am filing for custoday of both children. Can anyone help me?

Are you listed on the birth certificate.

What role if any has the bio father had.

She gave birth a month before. THe father has no role at all.

Since you weren't married at the time of birth then most likely your not the legal father.
