    Can I be evicted without a 30 day notice if not on a lease in Cobb county Georgia?
    I currently live with my girlfriend and not on the lease as she wanted me to move in with her about 3 months ago and I do pay rent here but now we are having problems in our relationship and wants me gone. Can she legally just throw me and my belongings out. I do receive mail here and even have a letter from the leasing office from the leasing manager stating that I live here even though I'm not on the lease.

    Hello C:

    No. You are a tenant, and she's your landlord. You have a month to month tenancy. Consequently, she needs to give you 30 days written notice, or you can sue her for unlawful eviction.

    Agreed but why do you want to stay in a home where you agree the relationship has gone south?

    You cannot be evicted without a court order. For her to get a court order she is going to have to give you a written notice to vacate within 30 days. Only if you have not vacated by the deadline can she file in court for an eviction order.

    If she prevents you from entering the premises or removes your belongings without giving such a notice or before the notice expires she will be guilty of an illegal eviction and can be sued.

    ALL I speak about is my personal experience with the Cobb Cunty Police. This occurred some years ago. I was renting an apartment, and let an old friend move in, because they were homeless. He paid me cash for the back bedroom. My phone got cut off. I gave him the money and took him to get it turned on in his name. He got drunk and did some embarresing things. I told him the nest day he had to leave. Police came and said, "You messed up lady, when you let him get utilities put in his name. he has rights now. You have to give him a 30 day notice." I gave him a $100 and then he just left.
