What can happen in NJ if a notice of discovery on an estate is not answered?
My brother in law is being sued by the rest of the family for taking my father in laws house after his death. He had the will changed by forcing my father in law to revise it to leave everything to him. Our lawyer has filed a motion of discovery and neither he nor his lawyer have answered it. What can we do at this point to get either mediation or a judge to hear our case? It seems that the estate lawyer we hired is just biding his time and charging us for frivolous things.

The next step is to file a Motion to Compel the Production of Discovery. The judge will rule on this at a hearing.

And after that you would ask for a bench warrant and seizure notice and take everything they have and tie it up until it is looked over.
