I have a 3 month olf newborn. The father is a Candian citizen. I am a U.S. citizen. When I was two months pregnant he left and didn't return until the day of our dautghers birth. He stayed for one month... left for three weeks... returned four days... left for six weeks.. and is now returning for a week. He is now requesting that he keep her during the day while I work. We have no papers drawn up because he will not attend a lawyers meeting with me. I am scared that he can just run off with her while I am at work. What do I do?

I don't think it is a good idea that he babysit for you, christyhaley. You don't have to agree to that. If he won't attend a lawyer with you to discuss all your options, then he is out in the cold for now at least. Who is tending your baby while you work, at the present time?

What is the nature of the relationship with this man? Are you two a couple? Does he stay with you on these visits? Does he support you in any way financially? Are you in your own home?

As he has been there more than half of the baby's life, 41 out of 60 days, I'd say he has a legitimate interest in his baby.

He certainly is entitled to see his baby girl, and the when and how much, should be up to a court to decide. You need to establish custody and visitation, probably the sooner the better.

Three months is already too long to wait to do that. Instead of worrying what will happen if he crosses the border into Canada with her, eliminate that worry with good legal advice, so it isn't a problem in the first place.

2. is he listed on the birth certificate.

Those are two important questions we need to know.

Have you filed for full custody in court, your attorney will have to push ahead if he refuses to go to hearings, and if he just won't show up, you are sure to win.

Next be sure and get a child support order in place
