It is the having sex that is still a issue. The age of consent is still 18 on the books. So the 18 year old would be a rapist if they had sex.

The GA supreme court a few weeks ago, over turned the conviction for the rape of a 17 year old, but this is likely to go to the US supreme court, because the law as written states 18, and the courts in GA are still charging and going to trial if one partner was 17.
