    Probation violation in virginia
    I am 20, on probation for illegal possession of alcohol for drinking on the beach - I went to my PO and because I had been drinking at a party the night before, when I took a breathalizer, it showed alcohol. She is sending this information to my probation officer in the county this happened in and says that she can decide to put me in jail. Do you know if I can really do jail time for drinking on the beach? And... what can I do to help prevent this now? I tried to talk her out of it but she said nothing she could do, it was my own fault. Can a lawyer help me at this point?

    A Lawyer certainly won't hurt you!

    I would assume the terms of your probation forbid you from drinking. Yes, you can go to jail for the term you would have received had you not received probation as well as any additional sentence.

    Or you can get a stern lecture, fine, more probation.

    It's entirely up to the Judge.

    And, yes, you can do jail time. I know someone who did jail time for fireworks on the beach.

    First, you are underage and are already on probation for underage drinking.

    Second, you are still drinking alcohol - regardless if it's on the beach or not - you are still underage and you are still drinking.

    What part of you are underage and still drinking alcohol don't you understand?

    Yes, the Judge can and probably will have you spend some time in jail as you can't get it through your head that you are underaged and are still drinking alcohol.
