I was employed for nearly 3 years and for 2.5 years I was a supervisor. Back in March/06 my employer received a notice of attachment from family maintenance to deduct wages for child support. He approached me and told me that in order to minimize payments, part time wages should be disclosed and the rest would be banked. He put me in a position of trust and did not question as to why he would do this. As a result, I kept track of my hours and he did allow me to withdraw when I requested it. It was
Agreed thiswould be a temporary arrangement. I asked for statements pertaining to my banked hours but he never gave me one piece of paper, and again I did not question his actions. 15 months later I decided to cancel our agreement and he tried to discourage me stating that Family Maintenance would get a large portion if I decided to close the time bank. However this time he could not persuade me but when pay day arrived, no changes were made which resulted into an altercation and he thought I should be happy to know I received a bonus. Without thinking of the negative consequences, I told him I would report his wrong doing including hiring illegal workers. He did not take kindly to this and in 10 days I received my firs warning letter stating I owed him money and that my performance was not good. He wanted me to sign and date this letter, but I refused because the contents of this letter was totally false. I was given a raise in April/07, received a bonus in July 15/07 and 10 days later, I became incompetent? I did not sign but on July 31/07 I had to sign because he withheld my pay and told me I would be dismissed. I DID NOT SIGN THIS LETTER VOLUNTARILY. This was an unfair tactic and because he was only paying me $400 every pay day, I was barely surviving. I had no other source of income so I signed and then I told him I would pursue this and that he should disclose my full hours and show and state deductions. He refused. I was demoted on the spot but he told me my wages would not decrease.
He replaced my position with an illegal worker who could not speak English and purposely told the crew members that I was to take orders from the new illegal supervisor male in his early 20's. I was embarrassed to say the least but I held my head up high and went along with this. This did not stop my employer from giving me back to back warning letters that were nothing to do with my performance. All I asked was to take time off to seek other employment and he stated this in a letter I was not to ask again. The third letter said I did not call the office. My dad's passing, unfavourable treatment caused me to ask for time off. My first request in 3 years. He had no problem with this but told me I would not receive any holiday pay. I was devastated and told him I was entitled for a 2 week paid vacation. I was dismissed and when I asked on what grounds, he said insubordination but did not provide details. Two weeks went by and I got a cheque marked void. I have filed a notice of claim. Don't you think I was treated unfairly because his motive is not my performance but the real motive is vengeance because I would report his wrongdoings and he was very angry.
